Terms of Service for Low End Dynasty (DBA Kulture Cru)
1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE

This is a legal agreement between you ("User" or "You") and Low End Dynasty, doing business as Kulture Cru ("Kulture Cru," "We," or "Us"). By accessing or using the website or services provided by Low End Dynasty (the "Service"), including purchasing music and merchandise, you agree to be bound by the following terms and conditions (the "Terms of Service" or "Agreement"). If you do not agree to these Terms of Service, you should not use the Service.

These Terms of Service constitute the entire agreement between you and Kulture Cru, superseding any prior agreements or communications.

2. DESCRIPTION OF SERVICE

These Services include access to music and media, as well as the ability to purchase merchandise (collectively referred to as the "Products"). To access these Services, you must:

Additionally, the Service includes the ability to purchase music tracks, albums, and merchandise (such as clothing, accessories, and other branded items). The purchase of these Products is subject to the following terms:

Music Purchases: When purchasing music through Kulture Cru, you are granted a non-exclusive, non-transferable license to download or stream the purchased music for personal, non-commercial use. You may not reproduce, distribute, or create derivative works from the music without explicit permission.Merchandise Purchases: When purchasing merchandise, you agree to pay for the items as stated in the checkout process. All sales are final, but returns or exchanges may be permitted in cases where items are defective or incorrect. Refer to our Return and Refund Policy for more details.

3. CONDITIONS OF USE

By using the Service, you agree to:

5. AUTOMATIC CONVERSION OF TRIAL TO PAID ACCOUNTS

If Kulture Cru offers a free trial of the Service, you may be required to provide payment information. At the end of the trial period, your account may automatically convert to a paid subscription unless you cancel the trial before the end of the trial period. If payment cannot be processed, Kulture Cru will notify you, and failure to upgrade your account within three business days may result in suspension of your account.

6. USER ACCOUNT, PASSWORD, AND SECURITY

You are responsible for maintaining the confidentiality of your account and password. You agree to notify Kulture Cru immediately of any unauthorized use of your account. Kulture Cru will not be responsible for any loss or damage resulting from unauthorized use of your account.

7. DISCLAIMER OF WARRANTIES

Kulture Cru provides the Service on an "as is" and "as available" basis, without any warranties, express or implied. Kulture Cru does not guarantee that the Service will be uninterrupted, error-free, or secure. You understand that any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk.

8. LIMITATIONS OF LIABILITY

Kulture Cru will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of your use or inability to use the Service, even if Kulture Cru has been advised of the possibility of such damages.

9. NO RESALE OR COMMERCIAL USE OF THE SERVICE

Your right to use the Service is personal to you. You may not resell, redistribute, or make any commercial use of the Service, including the Products (music or merchandise), without the prior written consent of Kulture Cru.

10. SECURITY OF STORED DATA AND FILES

Kulture Cru will take reasonable precautions to protect the data and files you store or retrieve through the Service. However, Kulture Cru cannot guarantee the absolute security of your data, and you are responsible for any loss or damage to your data.

11. PAYMENT AND BILLING

For any purchase of music or merchandise, you agree to pay the full price as stated in the checkout process. All payments will be processed via a third-party payment processor, and you agree to abide by their terms and conditions for payment processing. You are responsible for ensuring that all payment information is accurate and up to date.

Merchandise Refund Policy: Merchandise purchased through Kulture Cru can only be returned or exchanged if the product is defective or incorrect. You must notify Kulture Cru within a specified time frame after receiving the item for any potential returns or exchanges.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Kulture Cru, its affiliates, contractors, and employees from any claims, demands, or actions arising from your use of the Service, purchase of Products, or violation of these Terms of Service, including any legal fees or costs.

13. ACCOUNT SUSPENSION

Your account may be suspended if you fail to provide valid payment information or violate these Terms of Service. If your account is suspended, you will have a limited time to provide updated payment information or resolve the issue. Failure to do so may result in account termination.

14. TERMINATION

Kulture Cru may terminate or suspend your access to the Service if you violate these Terms or for any other reason at its sole discretion. You may terminate your account at any time by discontinuing use of the Service and notifying Kulture Cru of your intention. Upon termination, your access to the Service and all related data may be lost.

15. NOTICE

Kulture Cru may provide notices or communications to you by email or through the Service. You agree to accept electronic communications regarding updates, changes, or important information about the Service.

16. PROPRIETARY RIGHTS TO CONTENT

All content provided by Kulture Cru, including but not limited to text, images, videos, logos, music tracks, albums, and merchandise, is protected by intellectual property laws. 17. GOVERNING LAW

These Terms of Service shall be governed by the laws of the jurisdiction in which Kulture Cru operates, without regard to its conflict of law provisions. By using the Service, you consent to the exclusive jurisdiction of the courts in that jurisdiction for the resolution of any disputes.
